Welcome to Hootenanny, a platform operated by Fanclub Ltd. By accessing or using our platform, you agree to these Terms of Service (“Terms”). If you do not agree, please do not use the platform.

1. Acceptance of Terms

1.1 By using Hootenanny, you accept these Terms in full. Continued use after updates constitutes acceptance of any changes.
1.2 These Terms apply to all users, including visitors, fans (subscribers), and artists.

2. User Eligibility

2.1 You must be 18 or older to subscribe to fanclubs or upload content as an artist.
2.2 Visitors may browse the platform without age restrictions.

3. User Accounts

3.1 Users are responsible for keeping account credentials secure.
3.2 Notify Hootenanny immediately if you suspect unauthorized access or misuse of your account.

4. Acceptable Use

4.1 Users agree to:

• Use Hootenanny only for lawful purposes

• Comply with the Fair Use Policy and all other platform agreements

4.2 Prohibited activities include, but are not limited to:

• Uploading or sharing illegal, obscene, or sexually explicit content

• Harassment, bullying, or abusive behaviour towards other users

• Sharing or redistributing fanclub content outside the platform

• Using the platform to infringe third-party rights, including intellectual property

  
  

5. Fanclub Content and Licence

5.1 Fans are granted a limited, personal, non-commercial licence to view fanclub content as part of their subscription.
5.2 Fans may not share, download, redistribute, or upload content outside the platform.
5.3 Breaching these terms may result in suspension, termination, or legal action.

6. Hootenanny’s Role

6.1 Hootenanny acts as a facilitator between fans and artists and is not a party to fanclub agreements.
6.2 Hootenanny does not guarantee uninterrupted service or platform functionality.
6.3 Hootenanny provides tools for artists and fans to manage data and content in compliance with applicable laws, including GDPR.

7. Data Collection, Processing, and Sharing

7.1 Personal data may be collected during subscriptions, lead generation campaigns, and platform interactions. This includes name, email, location (city-level only), and engagement data.
7.2 Data shared with artists is aggregated or anonymised, unless users provide explicit consent to share emails. Full postcodes, exact addresses, and purchase-linked names are never shared.
7.3 Users may withdraw consent for data sharing at any time.
7.4 All processing of personal data complies with the Privacy Policy and applicable data protection laws.

8. Termination

8.1 Hootenanny may suspend or terminate accounts at its discretion, including for:

• Breaches of these Terms or platform policies

• Uploading prohibited content

• Bullying, harassment, or abusive behaviour

• Actions that harm Hootenanny’s operation, reputation, or other users

8.2 Decisions regarding termination are final.

9. Data Deletion and Retention

9.1 Users may request account deletion at any time.
9.2 Hootenanny retains personal data for up to 2 years after deletion to comply with legal, tax, and dispute obligations.
9.3 Artist-uploaded content may remain accessible to fans until the end of their subscription period.

10. Limitation of Liability

10.1 Hootenanny provides the platform “as is” with no guarantees.
10.2 To the fullest extent permitted by law, Hootenanny is not liable for:

• Platform downtime or technical issues

• Misuse of content or disputes between users

• Indirect, incidental, or consequential losses, including lost revenue

10.3 Hootenanny’s maximum liability is limited to platform fees paid by the user in the last 12 months.

11. Dispute Resolution and Governing Law

11.1 Users must first attempt to resolve disputes informally with Hootenanny.
11.2 These Terms are governed by the laws of England and Wales.
11.3 Unresolved disputes will be subject to the courts of England and Wales.

12. Changes to the Terms

12.1 Hootenanny may update these Terms at any time. Continued use constitutes acceptance of updated Terms.
12.2 Material changes will be posted on the platform.
